ATLANTIC CITY — A man who admitted shooting at an Atlantic City police officer nearly two years ago now wants to withdraw his guilty plea.
Gerald Spivey pleaded guilty last month to attempted murder and aggravated assault and was to be sentenced Friday. The 25-year-old Atlantic City man's plea deal called for a 20-year state prison term, with 17 years of parole ineligibility.
Atlantic County prosecutors say Spivey shot at Officer Dawn Riggs outside a bar in December 2008 after Riggs saw him shooting at someone. No one was hurt in either shooting.
But Spivey's attorney, Robert Gamburg, told Judge Charles Middlesworth Jr. that his client has "asserted his innocence" and wants to withdraw his plea.
Middlesworth will consider Spivey's request Aug. 6 and, if it's denied, will then immediately impose the sentence.
